Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CinterForge and related services (the “Service”) provided by Collectible Intelligence Inc. (“Collectible Intelligence,” “we,” “us,” or “our”). By downloading, installing, or using CinterForge, visiting https://collectibleintelligence.com, or accessing any related services, you agree to these Terms. If you do not agree, do not use the Service.

1. Changes to Terms

We may revise these Terms periodically.
Updated versions will be posted with a new effective date.
Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility & Accounts

You must be at least 13 years old to use the Service.
If you are between 13 and 17, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
Some features may require an account; you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
Access via platforms such as Steam or Discord may be subject to those platforms’ separate terms and privacy policies.

3. License to Use

Subject to these Terms, Collectible Intelligence Inc. grants you a limited, non-exclusive, non-transferable, revocable license to use the CinterForge software for personal, non-commercial purposes.

You may not:

Reverse engineer, decompile, or attempt to extract source code.
Circumvent technical protections or licensing mechanisms.
Distribute, resell, sublicense, or otherwise make the Service available to others except as expressly authorized by us.

4. User-Generated Content

You may create or upload content (such as prompts, generated images, metadata, or feedback) through the Service.

Ownership

You retain all rights to your own content.

License to Us

By submitting or sharing content through the Service, you grant Collectible Intelligence Inc. a limited, non-exclusive, and revocable license to host and display that content solely for the purpose of operating, maintaining, or troubleshooting the Service.

We will not use your content for marketing, analytics, or model-training purposes without your explicit consent.

Responsibility

You are responsible for ensuring that your content:

Does not infringe the intellectual property, privacy, or other rights of others.
Does not violate applicable laws or regulations.
Does not contain prohibited, harmful, or illegal material.

AI-Generated Content

When you use AI features, the output may be influenced by model training data. You are responsible for your use of AI-generated material and for complying with all applicable laws, including copyright and content regulations.

5. Intellectual Property

All software, interfaces, visual designs, and related assets of CinterForge and Collectible Intelligence are owned by Collectible Intelligence Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.
These Terms do not grant you any ownership rights in our intellectual property.

6. Acceptable Use

You agree not to:

Use the Service for unlawful, fraudulent, or harmful purposes.
Interfere with or disrupt the operation of the Service or attempts to gain unauthorized access.
Submit malware, malicious code, or automated scraping tools.
Misrepresent your identity or affiliation.

We may suspend or terminate access for violations of this section.

7. Payment & Subscriptions

If any features of the Service are offered for purchase or subscription:

Prices and terms will be disclosed at the point of sale (for example, via Steam or other platforms).
Payments are processed by third-party payment processors or platforms; Collectible Intelligence does not store your payment card details.
Refunds are governed by the applicable platform’s refund policy.

8. Disclaimers

The Service is provided on an “as-is” and “as-available” basis.
Collectible Intelligence Inc. makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee:

That the Service will be uninterrupted, secure, or error-free.
That any defects will be corrected.
That results obtained from the Service will be accurate or reliable.

Your use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law:

Collectible Intelligence Inc. and its affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or in any way connected with your use of the Service.
Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us for the Service in the six (6) months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Collectible Intelligence Inc., its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

Your use of the Service, or
Your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe that:

You have violated these Terms, or
You have engaged in fraudulent, abusive, or harmful activity.

Upon termination, your right to use the Service will immediately cease.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict of law rules.

In the event of a dispute:

The parties will first attempt to resolve the matter informally.
If not resolved, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in Delaware, unless prohibited by law.

You agree to:

Waive the right to a jury trial.
Waive the right to participate in a class action or class-wide proceeding.

13. Export Control

You agree to comply with all applicable U.S. export control and sanctions laws and regulations and not to use, export, or distribute the Service in any jurisdiction or for any purpose prohibited by such laws.
